Terms of Service
These Terms of Service ("Terms") constitute a legally binding agreement between you ("User," "you," or "your") and AM Interactive Software LLC ("ChatticaAI," "we," "us," or "our") governing your access to and use of the ChatticaAI mobile application (the "App").
BY DOWNLOADING, INSTALLING, ACCESSING, OR USING THE APP, YOU ACKNOWLEDGE THAT YOU HAVE READ, UNDERSTOOD, AND AGREE TO BE BOUND BY THESE TERMS. IF YOU DO NOT AGREE, YOU MUST NOT USE THE APP.
1. Eligibility and Age Requirements
1.1 Age Verification
The App may prompt you to manually enter your birth year to verify that you meet the minimum age requirement. This information is processed locally on your device, is not stored, is not transmitted, and is discarded immediately after verification.
You must be at least 18 years of age to download, install, or use the App. By using the App, you represent and warrant that:
- You are at least 18 years old
- You have the legal capacity to enter into these Terms
- Your use of the App does not violate any applicable laws in your jurisdiction
1.2 Geographic Restrictions
The App may not be available in all countries or regions. You are responsible for ensuring that your use of the App complies with all local laws and regulations.
1.3 Account Security
Core use of the App (chats, character cards, images, and settings) does not require an account. However, purchasing, restoring, or managing a subscription now requires you to sign in with Apple or Google to create a Chattica purchase account (see Section 2.4). You are responsible for maintaining the security of your device, your Apple/Google sign-in, and any API keys you configure within the App.
2. Description of Service
2.1 Local-Only Architecture
ChatticaAI operates almost entirely on your device. Key characteristics include:
- No Cloud Storage: Your content (character cards, chat histories, images, settings, and preferences) is stored exclusively on your device's local storage
- No Data Transmission to Us: We do not collect, transmit, upload, or store your content on our servers. The only exception is the purchase sign-in described in Section 2.4: when you choose to purchase or manage a subscription, your Apple/Google sign-in is verified through our authentication service and a purchase identity is associated with your subscription via RevenueCat (see Sections 2.4 and 4.3)
- No Analytics or Tracking: We do not implement analytics, tracking pixels, or telemetry that transmits usage data to us
- Offline Functionality: Core features work without an internet connection (though AI features and subscription sign-in require connectivity)
2.2 Third-Party AI Integration
The App allows you to integrate with third-party AI services using your own API keys, including but not limited to:
- OpenRouter
- OpenAI and OpenAI-compatible APIs (including Whisper for speech-to-text and TTS for text-to-speech)
- Anthropic
- LM Studio (local inference)
- Stable Diffusion (image generation)
- ElevenLabs (text-to-speech)
- On-device speech recognition (iOS Speech, Android SpeechRecognizer)
- On-device text-to-speech (iOS AVSpeechSynthesizer, Android TextToSpeech)
Important Disclosure: When you use these integrations, your device transmits data directly to the third-party AI provider. This includes your chat messages, prompts, character data, voice recordings (for speech-to-text), text for synthesis (for text-to-speech), and any other content you send. These transmissions occur directly between your device and the AI provider—ChatticaAI does not intercept, store, or have access to this data.
These integrations require you to provide your own API keys and are subject to the respective providers' terms of service and privacy policies.
2.3 Feature Overview
The App provides features including:
- Importing and managing character cards (PNG/JSON format)
- Text and voice-based chat with AI characters
- Speech-to-text input for hands-free messaging (on-device or via third-party APIs)
- Text-to-speech output for AI character responses (on-device or via third-party APIs)
- AI-generated image creation
- Local chat history management
- Content filtering and reporting mechanisms
- Optional subscriptions (see Section 2.4 and Section 4)
2.4 Accounts and Sign-In for Subscriptions
To purchase, restore, or manage a paid subscription, you must sign in with Apple or Google. This creates a Chattica purchase account.
- What we request: Sign-in uses minimal scopes. We request a stable, provider-issued identifier (the sign-in "subject") and do not request your name; an email address is only received if your provider supplies one. We do not receive or store your Apple or Google password.
- Purchase identity: From your sign-in we derive a purchase identifier (a RevenueCat "App User ID") that is stored on your device and used to associate and restore your purchases. Apple sign-ins are verified through our authentication service; see the Privacy Policy for details.
- Cross-platform vs. platform-specific: A Subscriber (monthly) plan can be restored across iOS, Android, and PC when you sign in with the same account. A Supporter (lifetime) purchase is platform-specific and tied to the store where you bought it.
- Account deletion: You can delete your purchase account from within the App (Manage Subscription → Delete Account). Deletion removes your sign-in from this device and requests server-side deletion of the associated purchase record. Deleting your account does not cancel an active subscription or refund a purchase — to stop billing, cancel in your device's App Store or Google Play subscription settings.
Your use of subscriptions and in-app purchases is also governed by Section 4 and by the applicable app store's terms.
3. User Responsibilities and Acceptable Use
3.1 Your Content
You retain all ownership rights to content you import, create, or generate using the App ("User Content"), including:
- Character cards and profiles
- Chat messages and conversations
- Images imported or generated
- Custom settings and preferences
3.2 Content Standards
You agree that all User Content will:
- Comply with all applicable laws and regulations
- Not infringe upon any third-party intellectual property rights
- Not violate these Terms or any third-party service terms
- Be appropriate for the mature (18+) audience for which this App is designed
3.3 Prohibited Content
You expressly agree NOT to import, create, generate, or use the App for content involving:
3.3.1 Strictly Prohibited Categories
- Child Sexual Abuse Material (CSAM): Any content depicting, describing, or sexualizing minors (individuals under 18 years of age), including but not limited to fictional depictions, age regression scenarios, or "aged down" characters
- Illegal Violence: Content depicting graphic torture, murder, dismemberment, or snuff content with intent to harm real individuals
- Human Trafficking: Content promoting, facilitating, or depicting sexual slavery, forced labor, or exploitation
- Non-Consensual Content: Content depicting or promoting sexual violence, rape, or non-consensual acts
- Illegal Bestiality: Content depicting sexual acts with animals
3.3.2 Detection Keywords (Non-Exhaustive)
Our content filtering system flags content containing keywords related to prohibited categories, including terms such as: "underage," "minor," "child," "loli," "shota," "teen," "preteen," "young," "kid," "toddler," "baby," along with combinations of these terms with sexual content.
This list is illustrative, not exhaustive. You remain responsible for all content regardless of whether it triggers automated filters.
3.4 Mature Content Policy
The App is rated for mature audiences (17+/18+) and permits adult content between consenting adult fictional characters, including:
- Romantic and sexual content involving adults
- Violence in fictional contexts (gaming, storytelling)
- Strong language and mature themes
However, content falling into Prohibited Categories (Section 3.3.1) is never permitted regardless of the App's mature rating.
4. API Keys and Third-Party Services
4.1 Your Responsibility
When using third-party AI services through the App:
- You are responsible for obtaining, managing, and securing your own API keys
- You must comply with the terms of service of each AI provider
- You are solely responsible for all costs, fees, and charges incurred through API usage
- You acknowledge that API keys grant access to paid services and must be kept confidential
- You consent to your data being transmitted to your chosen AI provider when you send messages, voice recordings, or request content generation
4.2 No Relationship with Third Parties
We are not affiliated with, endorsed by, or acting as an agent for any third-party AI service provider. We do not:
- Control the availability, performance, or reliability of third-party services
- Have access to your API keys (they are stored locally on your device)
- Have access to data transmitted between your device and AI providers
- Assume any liability for third-party service failures, outages, or billing issues
4.3 Subscriptions, RevenueCat, and Sign-In
The App offers a free tier and optional paid plans:
- Subscriber — an auto-renewing monthly subscription. It renews automatically unless canceled at least 24 hours before the end of the current period. Payment is charged to your Apple ID or Google Play account at confirmation of purchase. You can manage or cancel at any time in your device's store subscription settings; deleting your Chattica purchase account does not cancel it.
- Supporter — a one-time, non-renewing lifetime purchase that is specific to the platform where it was bought.
Purchasing, restoring, or managing a plan requires signing in with Apple or Google (Section 2.4). The App uses RevenueCat to process in-app purchases and manage subscription entitlements. RevenueCat may collect purchase history, transaction receipts, IP address, device information, country/currency, and a RevenueCat App User ID to validate transactions and enable restore across your devices. Your use of in-app purchases is subject to the applicable app store's terms and to RevenueCat's Privacy Policy. Prices are shown in your local currency at the point of purchase.
5. Content Filtering and Reporting
5.1 Automated Content Filtering
The App implements keyword-based content filtering to detect and block prohibited content during:
- Character card import
- Chat message creation
- Image generation requests
5.2 Limitations of Filtering
You acknowledge and agree that:
- Automated filtering is not perfect and may produce false positives or false negatives
- Filtered content may sometimes include benign or contextually appropriate material
- You remain fully responsible for your content even if it bypasses filters
- Filtering is a tool to assist compliance, not a guarantee of legality
5.3 Content Reporting System
The App includes an in-app content reporting feature accessible from the Help menu. This feature allows you to report AI-generated content you find objectionable.
How reporting works:
- You select "Report Content" from the Help menu
- You choose what to report (last generated image, last generated message, or other)
- You may add additional context
- The App opens your device's email client with a pre-filled report
- You choose whether to send the report

- The reported content (message text or image, if you choose to attach it)
- Character/persona name
- Timestamp
- App version
- Your additional comments
Important: Reports are only transmitted if you explicitly choose to send them via your email client. We do not automatically collect or transmit any content. Submitting a report is entirely voluntary.
5.4 How We Use Reports
Because your chats, characters, and generated content stay on your device and are never sent to us, we cannot:
- Associate reported content with a person (a purchase sign-in, if any, is used only for subscriptions and is not linked to your chat content)
- Remove content from users' devices
- Ban or suspend users
Reports help us:
- Identify potential issues with app functionality
- Improve content filtering and guidance
- Demonstrate good-faith compliance efforts
- Respond to legal obligations if illegal content is reported (e.g., CSAM reporting to NCMEC)
6. Intellectual Property Rights
6.1 Our Intellectual Property
The App, including its code, design, features, functionality, and documentation, is owned by us and protected by copyright, trademark, trade secret, and other intellectual property laws.
6.2 Limited License
Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to:
- Download and install the App on your personal device(s)
- Use the App for personal, non-commercial purposes
- Access the App's features and functionality
6.3 Restrictions
You may NOT:
- Reverse engineer, decompile, or disassemble the App
- Modify, adapt, or create derivative works of the App
- Remove, alter, or obscure any proprietary notices
- Rent, lease, sell, or sublicense the App
- Use the App for commercial purposes without our written permission
7. Privacy and Data Practices
7.1 Local Data Storage
All User Content and App data are stored exclusively on your device:
- Character cards and profiles
- Chat histories and messages
- Generated images
- Voice recordings (when using on-device speech features)
- API keys and settings
7.2 Third-Party Data Transmission
When you use third-party AI services, data is transmitted directly from your device to those services. This includes text messages, voice recordings (for speech-to-text), and text content (for text-to-speech). We do not intercept, store, or have access to this data. See our Privacy Policy for details.
7.3 Content Reports
If you voluntarily submit a content report, we may retain that report for quality improvement and legal compliance purposes.

8. Disclaimers and Warranties
8.1 "As Is" Provision
THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED.
8.2 Specific Disclaimers
We specifically disclaim warranties regarding:
- Functionality: No guarantee that the App will meet your requirements or operate uninterrupted
- AI Content: No responsibility for content generated by third-party AI services
- Accuracy: No guarantee that AI-generated content will be accurate, appropriate, or suitable
- Speech Recognition: No guarantee of accuracy for speech-to-text transcription, whether on-device or via third-party services
- Voice Synthesis: No guarantee of quality or naturalness for text-to-speech output
- Third-Party Services: No control over or responsibility for third-party AI providers
- Security: No warranty that the App is free from viruses, malware, or vulnerabilities
9. Limitation of Liability
9.1 Maximum Liability Cap
TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR TOTAL AGGREGATE LIABILITY ARISING OUT OF OR RELATED TO THESE TERMS OR YOUR USE OF THE APP SHALL NOT EXCEED THE GREATER OF: $50 USD, or the amount you paid for the App in the 12 months preceding the claim.
9.2 Excluded Damages
IN NO EVENT SHALL WE BE LIABLE FOR:
- Indirect Damages: Lost profits, revenue, data, or business opportunities
- Consequential Damages: Damages resulting from use or inability to use the App
- Incidental Damages: Costs of procurement of substitute services
- Special Damages: Damages specific to your circumstances
- Punitive Damages: Damages intended to punish wrongful conduct
10. Indemnification
10.1 Your Indemnification Obligations
You agree to indemnify, defend, and hold harmless ChatticaAI, its affiliates, officers, directors, employees, agents, licensors, and service providers from and against any and all claims, liabilities, damages, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising from or related to:
- Your Use of the App: Any claims related to how you use or misuse the App
- User Content: Any content you import, create, generate, or store in the App
- Terms Violations: Your breach of any provision of these Terms
- Law Violations: Your violation of any applicable law or regulation
- Third-Party Rights: Your infringement of any third-party intellectual property, privacy, or other rights
11. Term, Termination, and Suspension
11.1 Term
These Terms commence when you first download or use the App and continue until terminated by either party.
11.2 Your Right to Terminate
You may terminate these Terms at any time by:
- Uninstalling and deleting the App from all your devices
- Ceasing all use of the App
- Deleting all User Content (optional)
11.3 Our Right to Terminate
We reserve the right, in our sole discretion, to:
- Remove the App from app stores (Apple App Store, Google Play Store)
- Discontinue development, updates, or support for the App
- Block distribution of future versions
- Terminate these Terms with or without notice
12. Dispute Resolution and Arbitration
12.1 Informal Resolution
Before initiating any formal dispute resolution, you agree to contact us at support@chattica.ai and attempt to resolve the dispute informally for at least 30 days.
12.2 Binding Arbitration
If informal resolution fails, any dispute arising out of or relating to these Terms or the App shall be resolved through binding arbitration rather than in court, except as provided below.
12.2.1 Arbitration Rules
Arbitration will be conducted by:
- Arbitration Provider: American Arbitration Association (AAA)
- Rules: AAA Consumer Arbitration Rules
- Location: Arbitration shall take place in Houston County, Alabama or remotely via video conference
- Language: English
12.3 Class Action Waiver
YOU AND WE AGREE THAT DISPUTES WILL BE RESOLVED ON AN INDIVIDUAL BASIS ONLY. You waive any right to participate in a class action lawsuit or class arbitration.
13. General Legal Provisions
13.1 Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of Alabama, United States, without regard to its conflict of law principles.
13.2 Jurisdiction and Venue
For disputes not subject to arbitration, you agree to the exclusive jurisdiction and venue of the state and federal courts located in Houston County, Alabama.
13.3 Severability
If any provision of these Terms is found invalid or unenforceable, that provision shall be modified to the minimum extent necessary to make it enforceable, or if modification is not possible, the provision shall be severed. All other provisions remain in full force and effect.
13.4 Entire Agreement
These Terms constitute the entire agreement between you and us regarding the App and supersede all prior agreements, understandings, representations, and warranties.
13.5 Data Protection Laws (GDPR/CCPA/Global Privacy Laws)
ChatticaAI does not collect, transmit, or store your chat content, so those privacy rights are exercised directly by you through management of your device data. For the limited purchase sign-in described in Sections 2.4 and 4.3, you may exercise your rights by deleting your purchase account in-app or by contacting support@chattica.ai. Any data processed by third-party providers—including AI services, Apple/Google sign-in, or RevenueCat—occurs under their respective privacy policies.

15. Acknowledgment and Consent
By using ChatticaAI, you acknowledge that:
- You have read and understood these Terms in their entirety
- You are at least 18 years of age
- You agree to be bound by these Terms and all policies referenced herein
- You understand that your chat content stays on your device and we have no access to it
- You understand that purchasing or managing a subscription requires signing in with Apple or Google (Sections 2.4 and 4.3)
- You understand that when you use third-party AI services, your data is transmitted directly to those providers
- You understand that voice features may transmit audio data to third-party services depending on your configuration
- You consent to such data transmission when you choose to send messages, voice recordings, or generate content
- You are solely responsible for all User Content you import, create, or generate
- You will comply with all applicable laws and third-party terms of service
- You will not use the App for prohibited content categories
- You understand that content filtering is imperfect and you remain responsible
- You accept all risks associated with using AI-generated content
- You agree to indemnify us for claims arising from your use of the App
IF YOU DO NOT AGREE TO ALL OF THESE TERMS, YOU MUST IMMEDIATELY STOP USING THE APP AND UNINSTALL IT FROM YOUR DEVICE(S).
Appendix A: Prohibited Content Reference
This appendix provides additional detail on content categories that are strictly prohibited under Section 3.3.
Category 1: Child Sexual Abuse Material (CSAM)
Definition: Any content that depicts, describes, solicits, or sexualizes minors (individuals under 18 years of age).
Includes:
- Photographic, illustrated, or AI-generated depictions of minors in sexual contexts
- Text-based sexual content involving characters identified as or implied to be minors
- "Aged down" versions of adult characters placed in sexual contexts
- Age regression scenarios with sexual elements
- Fictional child characters (including anime/cartoon) in sexual situations
Zero Tolerance: This category has zero tolerance. Any violation may result in immediate termination and reporting to authorities.
Category 2: Illegal Violence
Definition: Graphic content depicting realistic torture, murder, or extreme violence against identifiable real persons.
Permitted Exceptions:
- Fictional violence in gaming or storytelling contexts
- Historical violence for educational purposes
- Self-defense scenarios
- Combat sports (boxing, MMA, etc.)
Category 3: Human Trafficking and Exploitation
Definition: Content promoting, facilitating, or depicting human trafficking, sexual slavery, or exploitation.
Permitted Exceptions:
- Educational content about anti-trafficking efforts
- Fictional consensual BDSM between adults (with clear consent)
- Historical discussions of slavery (educational context)
Important Notes
- Context Matters: Some keywords may be acceptable in non-sexual contexts
- False Positives: Legitimate content may occasionally be flagged
- Evolving List: This list is updated periodically based on emerging concerns
- User Responsibility: You are responsible for all content, even if not detected by filters
